Terms & Conditions for Tajiriba Africa

Welcome to Tajiriba Africa (“Tajiriba,” “we,” “us,” or “our”), a Pan-African crowdfunding and sports marketing platform accessible at tajiriba.africa.
By accessing or using our website, mobile application, or any related services (collectively, the “Platform”), you agree to be bound by these Terms and Conditions (“Terms”). If you do not agree to these Terms, please do not use the Platform.

Acceptance of Terms

By registering, accessing, or using the Platform, you confirm that you have read, understood, and agree to be bound by these Terms, as well as our Privacy Policy. These Terms apply to all users, including Fundraisers (athletes, sports clubs, academies, schools, or other entities creating campaigns), Funders (donors, sponsors, or supporters contributing funds), and visitors to the Platform.


Tajiriba provides a crowdfunding and sports marketing platform to:

  • Enable Fundraisers to create campaigns for sports-related funding needs.
  • Facilitate contributions from Funders.
  • Offer marketing support, campaign management tools, and premium features to enhance fundraising success..
  • Provide additional services such as Tajiriba Travel, Tajiriba Medical, Tajiriba School Fees, and Tajiriba Impact Fund.

Eligibility

You must be at least 18 years old or have the consent of a legal guardian to use the Platform.
You must have the legal capacity to enter into binding agreements.
To use certain features of the Platform, you may be required to register for an account. You agree to provide accurate, current, and complete information during the registration and campaign creation process.
You must not be prohibited from using our services under applicable laws.


User Responsibilities

Fundraisers

  • Campaign Creation: You agree to create campaigns that are truthful, accurate, and compliant with applicable laws. Campaigns must align with sports-related objectives and not involve illegal, offensive, or inappropriate content.
  • Use of Funds: Funds raised must be used solely for the purposes stated in the campaign description. Misuse of funds may result in account suspension, legal action, or refund obligations.
  • Campaign Updates: You agree to provide regular updates to Funders about campaign progress and fund utilization.
  • Verification: You may be required to provide identification, proof of eligibility, or other documentation to verify your identity or campaign legitimacy.

Funders

  • Contributions: Contributions are voluntary and non-refundable, except in cases of fraud or as required by law. You acknowledge that contributions are processed through third-party payment gateways, subject to their terms.
  • Due Diligence: You are responsible for reviewing campaign details before contributing. Tajiriba does not guarantee the success or legitimacy of campaigns but implements verification processes to minimize fraud.

All Users

  1. You agree not to use the Platform for any unlawful, fraudulent, or harmful activities, including but not limited to:
    • Posting false or misleading information.
    • Engaging in money laundering or terrorist financing.
    • Violating intellectual property rights or privacy laws.
  2. You are responsible for maintaining the security of your account credentials and notifying us immediately of any unauthorized access.

Platform Fees & Payment Terms

  • Platform Fees: Tajiriba charges a 10% platform fee on successfully funded campaigns. Additional fees may apply for premium campaign features, marketing services, or other optional services.
  • Payment Processing: Payments are processed through secure third-party gateways. You agree to comply with their terms and conditions.
  • Taxes: Fundraisers are responsible for any taxes applicable to funds raised or services received. Tajiriba may withhold taxes as required by law.
  • Currency: Contributions may be made in multiple currencies, subject to exchange rate fluctuations and applicable fees.

Intellectual Property

Content Ownership: You retain ownership of content you submit to the Platform. By submitting content, you grant Tajiriba a non-exclusive, worldwide, royalty-free license to use, display, and promote your content for Platform-related purposes.
Platform Content: All Tajiriba-owned content, including logos, designs, and software, is protected by copyright, trademark, or other intellectual property laws. You may not reproduce, modify, or distribute such content without our written permission.


Termination & Suspension

We reserve the right to suspend or terminate your account or access to the Platform if you violate these Terms, engage in fraudulent activity, or for any other reason deemed necessary to protect the Platform or its users.
You may terminate your account at any time by contacting us at support@tajiriba.africa.


Limitation of Liability

  • Tajiriba provides the Platform on an “as-is” basis and does not guarantee the accuracy, reliability, or success of campaigns.
  • To the fullest extent permitted by law, Tajiriba, its affiliates, and partners shall not be liable for any direct, indirect, incidental, or consequential damages arising from your use of the Platform, including but not limited to losses from campaign failures, data breaches, or payment disputes.
  • Tajiriba is not responsible for the actions or omissions of Fundraisers, Funders, or third-party service providers.


Indemnity

You agree to indemnify and hold Tajiriba, its affiliates, officers, and employees harmless from any claims, losses, or damages arising from your use of the Platform, violation of these Terms, or infringement of third-party rights.


Governing Law & Dispute Resolution

  • These Terms are governed by the laws of The Republic of Kenya. Any disputes arising from these Terms or your use of the Platform shall be resolved through negotiation or mediation. If unresolved, disputes shall be subject to the exclusive jurisdiction of the courts in Mombasa, Kenya.
  • For users in other countries, additional local laws may apply as Tajiriba expands.


Changes to Terms

We may update these Terms from time to time. Changes will be posted on the Platform, and continued use after such changes constitutes acceptance of the updated Terms.
